The US Constitution was written and signed by men who craved independence from Britain but who were nonetheless steeped in its history and ideals.

The document starts with some basic precepts of English governance, but then adds some uniquely American twists — three branches of government that act to check and balance each other, for example.

Although much thought went into the Constitution, the framers left it open to amendment. The first ten amendments were ratified just four years after the Constitution itself and are known as the Bill of Rights.

THE FIRST TEN AMENDMENTS: THE BILL OF RIGHTS

Some of the signers of the U.S. Constitution felt the need to spell out the rights of individual citizens in contrast to the establishment of the powers of the federal government enumerated in the Constitution itself. Thus, the first ten amendments to the Constitution, called the Bill of Rights, were ratified as a group by December 15, 1791. They are:

  • Amendment I: Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.
  • Amendment II: A well regulated militia being necessary to the security of a free State, the right of the people to keep and bear arms shall not be infringed.
  • Amendment III: No Soldier shall, in time of peace be quartered in any house, without the consent of the Owner, nor in time of war, but in a manner to be prescribed by law.
  • Amendment IV: The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
  • Amendment V: No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.
  • Amendment VI: In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defense.
  • Amendment VII: In Suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved, and no fact tried by a jury, shall be otherwise re-examined in any Court of the United States, than according to the rules of the common law.
  • Amendment VIII: Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.
  • Amendment IX: The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.
  • Amendment X: The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

Frankly, I don't know what answer you're expecting from a foreigner.

In my country (and I live in a democracy), it's not possible to have just two political parties (that's called a dictatorship, like in China or Russia). And a majority voting (where just one party can win the elections) between two parties isn't democratic either. To be honest, you have no idea what right-wing or left-wing parties are. In here, the Democrats would be on the right wing and the Republicans would be on the extreme right wing (who are not part of any government because they are subject to a "sanitary string" given what they advocate, just like the extreme left parties) and we have, in addition to you, the center parties and (real) left-wing parties.

Where I live, you only vote once, and all the political parties, with the percentages they have obtained, have to negotiate and reach a majority in Parliament by forming alliances (to get more than a simple majority : 50%). Knowing that if they want to change the constitution, they need a 75% majority.

This way of doing things protects us from the possibility of a new government overturning the decisions of the previous government (which cost millions, if not billions, of taxpayers' money) and forcing the political parties to negotiate a common agenda.

We also have a strict separation of powers: legislative, executive and judicial. The federal legislative power makes laws and controls the executive power. It is exercised by Parliament (elected by citizens). The federal executive runs the country. It ensures that the laws are applied in practice and respected. Executive power is exercised by the government, made up of ministers and secretaries of state (elected by citizens). Judicial power is exercised by the courts and tribunals. It also reviews the legality of executive acts (judges are appointed by examination, and the best one becomes a judge) and are NEVER elected by either the executive or legislative branches (separation of powers !!!).

So I'm not sure what I could say, except that the United States has never been a democracy, that the only two parties are right-wing and that there is no separation of powers in this country.

I really wouldn't want to live in this kind of country ... where you are incapable of making a president respect even the constitution, and even less the laws ...

The strict seperation of powers might not be as strict as you think. While judges often cannot directly "create laws", they still do in effect through interpretting law and setting precent. They can interpret the law how they see fit which sets a precedent, effectively gauranteeing that's how that law will be followed. Sometimes they can also btreak precedent - rare, but also even more clear how they're effectively changing the law.
just an outsiders observations, but it doesn't seem all that important these days.

I learned my rights from YouTube with "1st amendment audit" videos. This is where folks go to a police station lobbies, post offices, prisons or courthouses and film. You wouldn't believe the reactions they get.

I watch a lot of the tv show cops. you would be surprised on how many people have ZERO clue on their basic rights like search and seizure.. also they don`t know that they cannot call their laywer on the street. I learned this shit my senior year of HS.
